Having in your possession or under your control any article for use in the course of or in connection with any fraud.

Points to prove

Article – s.8: includes any program or data held in electronic form (for example, card details or phishing software on a laptop or phone).
Possession or control – covers things kept at home or elsewhere, not just items carried.
Fraud – s.1: fraud by false representation (s.2), failing to disclose information (s.3) or abuse of position (s.4).

Unlike going equipped (Theft Act 1968, s.25), there is no “not at their place of abode” requirement. Articles at the defendant’s home are covered.
Examples: card skimmers, blank or cloned bank cards, false identity documents, lists of stolen card details, and templates for fake invoices.
Making or supplying articles for use in frauds is a separate, more serious offence under s.7 (10 years on indictment).
Fraud articles were removed from going equipped by the Fraud Act 2006, so they are dealt with here.
